The Level III grievance was dismissed by the School Board at the June 8,2010 School Board meeting based on the recommendations of the fact findersreport to the School Board. All remedies requested by the employee weregranted. Thanks to all that supported this process.Mr. Juan Montoya, Director of the Public Employee Labor Relations Board,in a letter dated June 2, 2010 stated, "I have reviewed the pleadings andlistened to the audio record of the hearing on the Motion to Dismiss(filed by Los Alamos Public Schools). Based on that review of the recordI find that the Union has raised enough of a question that the Los AlamosPublic Schools has violated PEBA in that it failed to negotiate in goodfaith as to teacher's duties. The Los Alamos Public Schools Motion todismiss is hereby denied."Mr. Montoya has retired from his position as director of the LaborRelations Board effective June 30, 2010. His replacement has not beenassigned. In the meantime, the Union is waiting for the recommendation ofthe school district regarding the next step in this process.
